- Subscription-based software products (SaaS)
- Enterprise AI Solutions
- AI implementation and automation
- Business process transformation
- Professional consulting and implementation services
- Technical support and managed services
Subscription products are provided under the applicable subscription plan, while Enterprise AI Solutions are delivered under a separate proposal, Statement of Work (SOW), Service Agreement, Master Services Agreement (MSA), or Annual Maintenance Contract (AMC), where applicable.
2. Eligibility & Accounts
You must be at least 18 years old and legally authorized to use the Services. If an account is required, you are responsible for maintaining the security of your account credentials and for all activities performed under your account.
3. Acceptable Use
You agree to use the Services responsibly and in compliance with applicable laws. You must not:
- Use the Services for unlawful, fraudulent, or harmful activities.
- Send unsolicited or unauthorized communications.
- Attempt to gain unauthorized access to our systems.
- Reverse engineer or interfere with the operation of the Services.
- Violate the terms or policies of any third-party platform connected to the Services.
- Misuse AI capabilities to generate illegal, deceptive, or harmful content.
If the Services are used for messaging or communications, you are responsible for obtaining any required permissions or consent before contacting individuals.
4. Customer Data
You retain ownership of the data you submit through the Services. You are responsible for ensuring that your data is accurate, lawfully collected, and that you have the necessary rights and permissions to process it. We process Customer Data only to provide, maintain, secure, and improve the Services, in accordance with our Privacy Policy.
5. Artificial Intelligence
Some Services include Artificial Intelligence and Generative AI capabilities. AI-generated outputs are intended to assist users and may occasionally contain inaccuracies or incomplete information. Customers are responsible for reviewing and validating AI-generated outputs before relying on them for business or operational decisions.
6. Third-Party Services
Our Services may integrate with third-party platforms, cloud providers, communication services, AI providers, payment gateways, and other business applications. Your use of those third-party services is governed by their respective terms and policies. PeopleXtreme is not responsible for the availability or performance of third-party services.
7. Fees & Payments
Subscription Services are billed according to the selected plan. Enterprise AI Solutions are billed according to the applicable proposal, quotation, Statement of Work (SOW), Master Services Agreement (MSA), Service Agreement, or Annual Maintenance Contract (AMC). Failure to make payment may result in suspension or termination of the applicable Services.
8. Intellectual Property
All rights, title, and interest in the Services, including software, documentation, branding, designs, APIs, and related technology, remain the property of PeopleXtreme or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services during the applicable subscription period or project engagement.
9. Service Availability
We continuously improve our Services and may update, modify, or discontinue features from time to time. While we strive to provide reliable Services, we do not guarantee uninterrupted availability or error-free operation.
10. Disclaimer
The Services are provided on an “AS IS” and “AS AVAILABLE” basis to the maximum extent permitted by law. Except where expressly agreed in writing, PeopleXtreme makes no warranties regarding uninterrupted availability, compatibility with every third-party system, or the accuracy of AI-generated outputs.
11. Limitation of Liability
To the maximum extent permitted by law, PeopleXtreme shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Services, including loss of profits, business opportunities, or data. Our total liability shall not exceed the amount paid by you for the applicable Services during the twelve (12) months preceding the event giving rise to the claim, unless otherwise required by applicable law.
12. Suspension & Termination
We may suspend or terminate access to the Services if you violate these Terms, fail to make required payments, misuse the Services, or where necessary to comply with legal, regulatory, or security requirements. Upon termination, your right to access the affected Services will end immediately.
13. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Prayagraj, Uttar Pradesh, India, unless otherwise required by applicable law.
14. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available on this page, and your continued use of the Services after any changes become effective constitutes your acceptance of the updated Terms.
